OBTIENE PGJE DEL TRIBUNAL DEL JUICIO SENTENCIA DE UN AÑO 9 MESES DE PRISIÓN CONTRA IMPUTADO POR LESIONES CULPOSAS
La Procuraduría General de Justicia del Estado informa, que obtuvo un fallo condenatorio en el juicio oral que se celebró en el Centro de Justicia Penal de San José del Cabo los días 17, 18, 19 y 20 del mes en curso.
El miércoles 17, inició la audiencia en la que el Fiscal debatió con la Defensa todas las pruebas que aportó contra un hombre, responsable del delito de lesiones culposas.
Los hechos ocurrieron el 26 de junio del 2016, en la carretera transpeninsular, tramo Cabo San Lucas - La Paz, en la entrada a la población de Santiago, el sentenciado conducía su vehículo sin la precaución necesaria, al intentar ingresar al poblado invadió el carril contrario y provocó el accidente en el que la víctima, sufrió lesiones que ocasionaron la pérdida de miembros inferiores.
Por lo anterior el agente del Ministerio Público llevó a cabo todas las diligencias previstas en el Código Nacional de Procedimientos Penales para inicialmente, integrar la carpeta de investigación y en su momento, ejercer Acción Penal en contra del hoy sentenciado, lo que se conoce ahora como la judicialización del asunto; posteriormente, dentro del plazo que concedió el juez, realizó la investigación complementaria y formuló la acusación.
Se ofrecieron y se admitieron las pruebas a las partes, y en su oportunidad, se dictó el auto de apertura a juicio que concluyó con la sentencia condenatoria en la que. Al detallarse la sanción, se estableció el número de años de prisión que se mencionan.
El sábado 27 se realizó la audiencia de individualización de sentencia, en la que el Tribunal de referencia precisó los años de prisión a imponer, una vez que fue hallado culpable.
