PROFEPA interpone denuncia penal al SAPA Mulegé por descarga de aguas negras al mar

La Procuraduría Federal de Protección al Ambiente (PROFEPA) interpuso denuncia penal por la descarga permanente de aguas residuales al mar, que se lleva a cabo en la Colonia Cuauhtémoc de la población de Santa Rosalía, Municipio de Mulegé, Baja California Sur, proveniente de la red de drenaje municipal, por realizarse sin previo tratamiento y sin contar con la autorización correspondiente.
Al realizar visita de inspección por parte del personal correspondiente, se constató la existencia de dicha descarga, sin tratarla previamente como lo señala la legislación ambiental, incumpliendo así la normatividad respecto de la calidad del agua que se descarga al cuerpo de agua nacional, para prevenir su contaminación.
Durante el proceso administrativo se ordenaron medidas, a fin de que se acreditara contar con autorización emitida por la Comisión Nacional del Agua (CONAGUA) para descargar aguas residuales en Cuerpos de Aguas Nacionales; no obstante, al llevar a cabo su verificación, resultó en incumplimiento.
Además, se ordenó la clausura de la actividad, consistente en descarga de aguas residuales en cuerpo de agua nacional, lo cual resultó en incumplimiento, pues al momento de verificarse, continuaba la actividad.
Ante tal situación, con fundamento en lo establecido por el artículo 416 del Código Penal Federal, se procedió a interponer denuncia penal ante la Procuraduría General de la República a fin de que se investiguen los hechos.
Aunando a lo anterior, esta Procuraduría procedió a dictar sanción por la infracción prevista en lo dispuesto por el artículo 121 de la Ley General del Equilibrio Ecológico y la Protección al Ambiente, en relación con los artículos 14 BIS 4 de la Ley de Aguas Nacionales.
La PROFEPA reitera su compromiso de verificar el cumplimiento de la legislación ambiental, en pleno ejercicio de sus atribuciones, a fin de garantizar el derecho a un medio ambiente sano, encaminado al desarrollo y bienestar de las personas, establecido en el Artículo 4° la Constitución Política de los Estados Unidos Mexicanos.
