Frena el Gobierno del Estado la publicación de despenalizar el exceso de la legítima defensa

Los recientes cambios aprobados en el Congreso del Estado referente al tema de despenalizar el “exceso de la legítima defensa”, será analizado contestó el Secretario General de Gobierno Álvaro de la Peña Angulo ante los medios de comunicación.
La exposición de motivos presentada en el dictamen establece que cuando un sujeto actúa en defensa de su vida o bienes propios o ajenos “tiene la justificación de exteriorizar una conducta que dañará al agresor, pero precisamente para defenderse de este agresor no puede haber ninguna sanción penal”, es decir que cuando una persona se ve obligada a defender su integridad y la de sus familiares ante una agresión concreta que se llegara a presentar en el propio domicilio no amerite una sanción, sin embargo esto según los expertos pudiera dar pie a hacer justicia por su propia mano en el Estado.
Pero el tema no es así de fácil aseguró la autoridad, pues tal parece que el Congreso aprobó una reforma al vapor, es decir sin hacer un análisis profundo con las instituciones correspondientes como Derechos Humanos y el mismo Tribunal Superior de Justicia del estado, así mismo no se tomo en cuenta la opinión de los ciudadanos “ademas es muy importante saber que es lo que opina la gente”, refirió de la Peña Angulo.
Más allá de las “buenas intenciones” el tema es más amplio, pues esto podría ocasionar a largo plazo un problema mayor “porque si por una buena intención se genera otra problemática mayor, yo creo que tendría que ser un tema de mucho análisis, no se ha publicado aun porque vamos a tener una pausas porque hay voces encontradas y no podemos irnos nosotros así”.
El tema esta en pausa, pues del Congreso del Estado pasará a manos del Ejecutivo dicho documento para su revisión, y conforme al análisis se determinará si se publica o no dicha aprobación.
La propuesta realizada en el Congreso del Estado por parte del Diputado Alfredo Zamora se ve por ciertos sectores de la sociedad como un simple hecho populista, con el fin de quedar bien ante los ojos de los ciudadanos (electorado) por el tema de seguridad que se vive en BCS, sin embargo expertos han señalado que al momento de acreditar ante un juez dicho concepto, si las carpetas de investigaciones no son bien estructuradas, la persona que en un principio era el afectado y agredió a un supuesto ladrón, puede terminar en la cárcel incluso con más años de prisión que el mismo ladrón.
Los fones que tuvo esta reforma fue simple y sencillamente un hecho electorero por parte del Diputado Zamora, buscando quedar bien con la ciudadania con fines para el 2018.
