Aprueba Congreso reformas a la Ley de Videovigilancia de BCS

En pasada sesión extraordinaria el Pleno del Congreso del Estado aprobó reformas a la Ley de Videovigilancia para el Estado con la finalidad de fortalecer a las instituciones públicas estatal y municipales para operar el sistema en todo el estado, como dotar de mayor flexibilidad a las empresas que operan esos sistemas.
El Pleno aprobó por unanimidad el dictamen de la Comisión Permanente de Seguridad Pública que preside la diputada Guadalupe Vázquez Jacinto, a la iniciativa formulada por la Secretaría de Seguridad Pública (SSP) del Gobierno del Estado, la Comisión Técnica de Vieovigilancia del Estado, integrada por servidores públicos y representantes de la sociedad civil de la entidad, misma a la que pertenece la diputada Vázquez.
En el momento de presentar la iniciativa en sesión pasada del 24 de mayo, la legisladora exponía que la iniciativa establecía la flexibilidad para que las empresas de todo tipo instalen sus sistemas de videovigilancia, con la finalidad de facilitar el trabajo a la autoridad ante la comisión de un posible ilícito.
Entre las reformas aprobadas destacan: que se adiciona que podrán ser sujetos de esta regulación, previo convenio que suscriban con la Secretaría, las personas físicas o morales, empresas de seguridad privada y establecimientos mercantiles, que dispongan de sistemas de videovigilancia en los espacios privados, pero con alcance a espacios públicos.
Se hace flexible que los establecimientos mercantiles, fraccionamientos y condominios instalen equipos de videovigilancia que brinden estándares mínimos de seguridad para ellos y los ciudadanos, con el propósito de prevenir y facilitar la reacción ante la comisión de hechos posiblemente delictivos.
El exhorto para la instalación de sistemas de videovigilancia, será de acuerdo a las posibilidades económicas de cada propietario, ya sea pequeños, medianos y grandes establecimientos, y quien tenga los recursos suficientes para instalar sistemas homologados a los que instalan las instituciones de seguridad pública, podrán hacerlo.
Se establece que el botón de alerta que instalen los establecimientos mercantiles en el Estado, podrá estar enlazado al C4, físicamente o a través de aplicaciones móviles, fijas o de escritorio, previo convenio de las empresas de seguridad privada y los establecimientos con la SSP para la conexión de un botón de alerta, de sus cámaras fijas o móviles a la red.
Se establece que como mínimo, las grabaciones deberán estar resguardadas durante 30 días naturales, contados a partir de la fecha de su captación. La redacción original imponía que las grabaciones se resguardaran por 60 días, lo que para algunos sistemas de videograbación era imposible soportar técnicamente.
Se plasma en la ley que, la Secretaría de Seguridad Pública, orientará y capacitará a los establecimientos mercantiles para la actualización, modernización y la buena operación de los equipos.
Se agrega como integrante de la Comisión Técnica de Videovigilancia a un Secretario Técnico, quien auxiliara al Presidente en la conducción y buena marcha de los trabajos de este cuerpo colegiado.
Y se armoniza la Ley de Videovigilancia con la Ley de Protección de Datos
Personales en Posesión de Sujetos Obligados para el Estado y con el interés superior de niñas, niños y adolescentes, conciliando, por un lado, el derecho a la seguridad pública y el derecho a la intimidad.
